Chief Justice Surya Kant urges mandatory AI disclosure and ethical guidelines to ensure transparency and efficiency in international arbitration.

Summary

Chief Justice of India Surya Kant addressed the transformative impact of Artificial Intelligence on international arbitration during the SIAC Annual India Conference-2026. He highlighted that AI has rapidly moved from the periphery to the center of arbitration practice, bringing practical challenges regarding accuracy, authenticity, and ethical use, such as the risks posed by deepfakes and undisclosed AI-generated submissions.

To mitigate these risks, the CJI advocated for mandatory disclosure when generative AI is used in witness statements or expert reports, arguing that this promotes transparency without hindering innovation. He also emphasized the need for shared industry standards to help tribunals consistently address AI-generated material and deepfakes, thereby strengthening confidence in the arbitral process.

Furthermore, Kant encouraged the responsible integration of AI for efficiency-boosting tasks like e-discovery, document management, and translation. He concluded by stressing that while technology evolves, the core principles of arbitration—such as neutrality, party autonomy, and timely resolution—must remain the fundamental focus.
