Two TVM youths sentenced to 10-year jail term for sexually assaulting minor

The Thiruvananthapuram Fast Track Special Court (POCSO) sentenced Jishnu J Mohan (24) and Vishnu R, alias Kannan (27) to 10 years of simple imprisonment for the sexual assault of a 17-year-old girl in Akkulam. The incidents occurred on June 27 and July 4, 2023, after Jishnu befriended the survivor and took her to Vishnu’s house where they provided alcohol. While the court acquitted them of charges related to intoxication and the Juvenile Justice Act due to lack of evidence, it upheld the primary charges of sexual assault, relying on the survivor’s testimony and medical findings.
The court emphasized that under the POCSO Act, a minor’s consent is legally invalid, regardless of substance use or voluntary accompaniment. It also highlighted Vishnu’s role in providing a “safe harbour” for the crime, warning against aiding such offenses.
Both convicts were fined ₹15,000, with an additional two years of imprisonment if the fine is not paid. The time already served will be deducted from their sentence, and the fine amount will be paid as compensation to the survivor. Special Public Prosecutor Vijay Mohan R S represented the state.
