The Kerala High Court Division Bench has stayed the order of a single bench that disqualified all office-bearers of the SNDP Yogam, including General Secretary Vellappally Natesan. The original order was issued on March 12th following a writ petition filed by SNDP Yogam Samrakshana Samithi, seeking to restrict the Yogam’s supervisory powers and appoint an administrator.

Vellappally Natesan and Thushar Vellappally appealed the single judge’s order, arguing that the case should have been heard by the National Company Law Tribunal, as it pertains to the Companies Act and internal management of a company. They contended that the writ petitions were not maintainable in the High Court, citing Section 430 of the Companies Act, which restricts civil court jurisdiction in such matters.

The appeal further stated that the single judge’s ruling suffered from jurisdictional errors, misinterpretation of facts, and incorrect application of statutory provisions regarding Director Identification Numbers (DIN) and disqualification. The Division Bench agreed with these contentions and issued the stay order, allowing Vellappally Natesan and other members to continue in their positions until a detailed order is published.
