Film inspired by Venjaramoodu mass murder won’t affect trial: CBFC to Kerala HC
Summary
The Central Board of Film Certification (CBFC) has defended the release of the movie 'Kaalam Paranja Kadha' in response to a petition filed by the father of an accused in the Venjaramoodu mass murder case. The petitioner argued the film could influence the trial, but the CBFC, represented by a Central government counsel, stated that after reviewing the film and comparing it to the FIRs, it found sufficient differences in names, circumstances, and the manner of the crime. The counsel also highlighted the film’s message against drug abuse and online gambling.
The petitioner’s counsel countered that the film reflects only the police version of events and potentially defames the family by allowing viewers to identify the accused. They argued that artistic freedom shouldn’t compromise a family’s dignity and that the trailer itself is defamatory. Concerns were raised that the Censor Board doesn’t adequately address defamation or potential impacts on a fair trial.
The filmmakers filed a counter affidavit denying the film is directly based on the Venjaramoodu case, asserting it won’t lead to trial by media or influence public opinion. They claim the film addresses social vices and doesn’t harm anyone’s reputation. However, the petitioner maintained that the film’s announcement, promotional content, and narrative similarities clearly link it to the Venjaramoodu incidents, potentially prejudicing a fair trial, especially given the influence of social media. The Court has adjourned the hearing to await the CBFC’s report.
