9th Circuit Nixes Suit re CIA Transfer of Terrorism Suspects Abroad, Cites State Secrets Privilege
By a 6-5 vote, a sharply divided federal appeals court issued an opinion (PDF) today that has put the brakes on a lawsuit concerning a controversial CIA program in which terrorism suspects reportedly were transferred overseas, where at least some were allegedly tortured. Upholding the Obama administration’s assertion of the state secrets privilege, a majority of the 9th U.S. Circuit Court of Appeals agreed that the suit would present an unacceptable national security risk if it continued, reports the New York Times. 3rd Circuit Gives Judges Discretion to Demand Warrants for Cell Phone Tracking
A federal appeals court has ruled that judges have statutory authority to demand a showing of probable cause when the government seeks cell phone location data to track criminal suspects. The Philadelphia-based 3rd U.S. Circuit Court of Appeals rejected a Justice Department argument that judges are required to issue orders giving the government access to the data on a showing that it is material and relevant to an ongoing probe, the Legal Intelligencer reports. Report Predicts More Equity Partners Will Be Axed, Sees More Outsourced Work
Most law firms cut equity partners the first half of 2010, but the bloodletting may not be over. A new survey of 187 law firms by Citi Private Bank shows flat revenues in the first six months of the year and slightly lower demand, according to a summary in the American Lawyer by Dan DiPietro, chairman of Citi’s Law Firm Group, and senior client adviser Gretta Rusanow. “At best, we may have reached a bottoming out,” they write. SEC Plummets in Best Federal Workplace Rankings; DOJ Gets Ninth Place
The lawyers and other employees who work at the Securities and Exchange Commission are more dissatisfied with their jobs this year, according to new “Best Places to Work” rankings of federal workplaces. The SEC was in 11th place last year, but this year it plummeted to the 24th spot on the list, the Washington Post reports. Being constantly tethered to your smartphone and other digital devices may interfere with the downtime needed for learning and creativity, studies suggest. Ohio Lawyer Suspended for Billing More than 24 Hours in a Day
An Ohio lawyer has been suspended for overbilling local courts for her representation of poor clients, submitting bills for more than 24 hours a day on three different occasions. The lawyer, Kristin Ann Stahlbush of Toledo, will be suspended for two years, with the second year stayed if she completes a one-year probationary period, the Legal Profession Blog reports. Reports: Ex-Sen. Ted Stevens Is Among 5 Dead in Alaska Plane Crash
After conflicting reports earlier in the day, CNN and other news media are now stating that the death of former Sen. Law Prof Sees More Plagiarism, Allows Do-Overs
An adjunct law professor who has taught at three law schools says he has caught a half a dozen students who plagiarized parts of their papers, and the problem seems to be increasing. Donald C. An investor in Tyco International Ltd. has turned the tables on Grant & Eisenhofer, contending in a malpractice lawsuit seeking class action status that the plaintiffs securities law firm concealed a fee agreement with the lead plaintiff in an earlier case and took an excessive payout from its own clients. Teen Tells of Abuse by Once-Prominent Lawyer in Videotaped Interview
In a videotaped interview played in court on Tuesday, a 15-year-old boy alternatively referred to the lawyer who had befriended him over the years, sharing pornography and then initiating sex in an October encounter, as “Aaron” and “Mr. Biber.” Aaron Biber was formerly the co-chair of the antitrust and trade regulation practice group at Gray Plant Mooty. An individual’s claim to own 84 percent of the popular Facebook Inc. social networking site, based on a years-old two-page “work for hire” website development contract calling for an up-front payment of $1,000, seemed more than a bit bizarre. But a New York state-court judge earlier this month granted a temporary restraining order prohibiting transfer of Facebook’s nearly $25 billion in assets while the matter is sorted out. Law students interviewing for law jobs need to show—and practice—their emotional intelligence by providing good answers to hypothetical questions and connecting with interviewers. New SEC Disclosure Rules Take Toll on GC Bonuses; Average Drops Below $1M
The total average cash bonus for general counsel at Fortune 500 companies has dropped by 18 percent, to below $1 million, and new SEC disclosure rules may be partly to blame. The average cash bonus, a combination of traditional bonuses and nonequity incentive compensation, is $947,781, Corporate Counsel reports. Traditional cash bonuses dropped 37.1 percent and nonequity incentive compensation, which is tied to performance targets such as profit or revenue, dropped 10 percent. Think Racial Profiling Is Unconstitutional? Read Brignoni-Ponce, Law Profs Say
Those who think the racial profiling encouraged in Arizona’s new immigration law is unconstitutional should think again, two law professors say. A 1975 U.S. Supreme Court decision, United States v. Two Georgia attorneys reportedly were operating a private law practice at the same time that they held full-time positions as staff lawyers at the State Ethics Commission.
