3rd Circuit Bars Child Porn Prosecution of Teen in Sexting Photo
A federal appeals court has upheld an injunction that bars the child pornography prosecution of a teen girl in Pennsylvania who appeared topless in a photo that ended up on high school students’ cell phones. The opinion by the 3rd U.S. Circuit Court of Appeals is the first decision by a federal appeals court involving “sexting,” according to the New York Times, the Associated Press, the Legal Intelligencer and the Philadelphia Inquirer. Federal Judge Impeached by House in Unanimous Vote
The House of Representatives voted 412-0 today to approve the first of four articles of impeachment against New Orleans District Judge Thomas Porteous. The article found the judge was engaging in misconduct by not disclosing his relationship with a lawyer before him in a hospital case, the Times-Picayune reported. EEOC Subpoenas Law Firm Documents in Sex Harassment Probe
The Malaise Law Firm in San Antonio, Texas, is clashing with the Equal Employment Opportunity Commission in the agency’s investigation of alleged sexual harassment at the law firm. The EEOC announced in a press release that it has filed a federal lawsuit seeking to enforce a subpoena for information from the firm. After litigation against judges and efforts to search their computers by the local government attorney in embattled Maricopa County, Ariz., the FBI has now expanded an earlier probe of the county sheriff’s office to include as well the office of County Attorney Andrew Thomas. Newspaper Illustrates ‘Explosion’ of Suits Over Mobile Device Patents
A lawsuit filed by Apple on Wednesday against Taiwanese handset maker HTC is just the latest in an “explosion” of lawsuits over patents relating to mobile devices. January Thaw: Legal Sector Layoffs Lessen, Total Only 1,100 or So

Saying that Elisabeth Anne “Betty” Broderick was angry, unrepentant, lacked insight into her crime and posed a risk to society, a two-member board yesterday denied the 62-year-old parole in the shootings of her ex-husband, a prominent California attorney, and his new young wife, who worked as his legal assistant. Haiti Quake Shakes Up Adoptions
After 38 months, the paperwork was finally complete Monday on an Arizona couple’s planned adoption of a 7-year-old boy from Haiti. But Tuesday the courthouse crumbled in the country’s massive earthquake. The adoption decree is somewhere in the rubble.
